Alto Pass Man Com­mit­ted for 51 Years for Sex Crimes

Union Coun­ty State’s Attor­ney Tyler R. Edmonds announced today that Bil­ly Wayne Van­der­graph (DOB 03-05-1938), for­mer­ly of rur­al Alto Pass, has been com­mit­ted to the Illi­nois Depart­ment of Human Ser­vices (DHS) for a peri­od of fifty-one (51) years.  Van­der­graph was indict­ed by a Union Coun­ty grand jury in July of 2010 on one (1) count of Preda­to­ry Crim­i­nal Sex­u­al Assault of a Child, a Class X Felony, and two (2) counts of Aggra­vat­ed Crim­i­nal Sex­u­al Abuse, both Class 2 Felonies.

After Van­der­graph was found to be unfit to stand tri­al, evi­dence was pre­sent­ed at a Dis­charge Hear­ing in Sep­tem­ber 2013.  At that hear­ing, the court found that the evi­dence showed that the defen­dant com­mit­ted acts of sex­u­al con­duct with a child under 13 years of age between Jan­u­ary and May of 2010 and that evi­dence would have been suf­fi­cient to con­vict Van­der­graph had he been fit to stand tri­al.  He is now required to reg­is­ter as a sex offend­er and will be placed in a locked facil­i­ty with­in the DHS sys­tem.  Van­der­graph is cur­rent­ly being held in the cus­tody of the Union Coun­ty Sher­iff at the Jack­son Coun­ty Jail in Mur­phys­boro, await­ing trans­fer to DHS.  The case was inves­ti­gat­ed the Union Coun­ty Sheriff’s Office and Illi­nois State Police.
