Ordinance Chapter: Article II - Liquor Control Commisioner

(A) No per­son shall sell, keep or offer for sale at retail, or con­duct any place for the sale at retail of alco­holic liquor with­in the lim­its and ter­ri­to­ry of the Coun­ty out­side the cor­po­rate lim­its of any incor­po­rat­ed city, vil­lage or incor­po­rat­ed town, with­out hav­ing a license to do so issued by the Liquor Con­trol Com­mis­sion­er, in the man­ner here­inafter pro­vid­ed, and a valid license for such pur­pose issued by the Illi­nois Liquor Con­trol Com­mis­sion.

(B) A sim­i­lar valid license issued by the Liquor Con­trol Com­mis­sion­er is required for, and with respect, to each and every premis­es, with­in the lim­its and ter­ri­to­ry of the Coun­ty out­side the cor­po­rate lim­its of any city, vil­lage or incor­po­rat­ed town, at or upon which alco­holic liquor is to be sold or kept or offered for sale at retail. (See 235 ILCS Sec. 5/4–1)

When, in this Chap­ter, the Liquor Con­trol Com­mis­sion­er shall be referred to, it shall include any com­mit­tee, agency or agent appoint­ed by such Liquor Con­trol Com­mis­sion­er, includ­ing, but not lim­it­ed to, Deputy Liquor Con­trol Com­mis­sion­ers, the Coun­ty Clerk, the Sher­iff and the State’s Attorney.

The Liquor Con­trol Com­mis­sion­er shall have the fol­low­ing pow­ers, func­tions, and duties:

(A) To grant and to sus­pend for not more than thir­ty (30) days or revoke for cause all local licens­es issued to per­sons for premis­es with­in the ter­ri­to­ry of the Coun­ty out­side the cor­po­rate lim­its of any city, vil­lage or incor­po­rat­ed town;

(B) To enter or to autho­rize any law enforc­ing offi­cer to enter at any time upon any premis­es licensed under this Chap­ter to deter­mine whether any of the pro­vi­sions of the Act or this Code or any rules or reg­u­la­tions adopt­ed by the Liquor Con­trol Com­mis­sion­er or by the Illi­nois Liquor Con­trol Com­mis­sion have been or are being vio­lat­ed, and at such time to exam­ine said premis­es of said licensee in con­nec­tion therewith;

(C) To noti­fy the Sec­re­tary of State where a club incor­po­rat­ed under the Gen­er­al Not for Prof­it Cor­po­ra­tion Act of 1986 or a for­eign cor­po­ra­tion func­tion­ing as a club in this State under a cer­tifi­cate of author­i­ty issued under that Act has vio­lat­ed this Act by sell­ing or offer­ing for sale at retail alco­holic liquors with­out a retailer’s license;

(D) To receive com­plaint from any cit­i­zen with­in the Coun­ty that any of the pro­vi­sions of this Chap­ter or the Act, or any rules or reg­u­la­tions adopt­ed pur­suant to this Chap­ter or the Act, have been or are being vio­lat­ed and to act upon such com­plaints in the man­ner pro­vid­ed in this Chap­ter or the Act;

(E) To receive license fees and pay the same forth­with to the Treasurer;

(F) To noti­fy the Sec­re­tary of State of any con­vic­tions or dis­po­si­tions of court super­vi­sion for a vio­la­tion of Sec­tion 6–20 of the Act or a sim­i­lar pro­vi­sion of this Chapter;

(G) To levy fines in accor­dance with this Chap­ter and the Act;

(H) To exam­ine, or cause to be exam­ined, under oath, any appli­cant for a license or for a renew­al there­of, or any licensee upon whom notice of revo­ca­tion or sus­pen­sion has been served in the man­ner pro­vid­ed by this Chap­ter and the Act, and to exam­ine or cause to be exam­ined, the books and records of any such appli­cant or licensee; to hear tes­ti­mo­ny and take proof for his infor­ma­tion in the per­for­mance of his duties, and for such pur­pose to issue sub­poe­nas which shall be effec­tive in any part of this State.  For the pur­pose of obtain­ing any of the infor­ma­tion desired by the Liquor Con­trol Com­mis­sion­er under this Sec­tion, the Liquor Con­trol Com­mis­sion­er may autho­rize his agent to act on its behalf.

(I) Any oth­er pow­ers, func­tions, or duties under this Chap­ter or the Act.

The Liquor Con­trol Com­mis­sion­er shall receive no addi­tion­al annu­al salary beyond com­pen­sa­tion received as a mem­ber of the Coun­ty Board.

The Chair­man of the Coun­ty Board shall be the Liquor Con­trol Com­mis­sion­er in the ter­ri­to­ry of the Coun­ty out­side the cor­po­rate lim­its of any city, vil­lage or incor­po­rat­ed town and is charged with the admin­is­tra­tion of the appro­pri­ate pro­vi­sions of the Act and this Chap­ter and any oth­er state laws or coun­ty ordi­nances per­tain­ing to the sale of alco­holic liquor.  The oth­er mem­bers of the Coun­ty Board shall be Deputy Liquor Con­trol Com­mis­sion­ers and shall assist the Liquor Con­trol Com­mis­sion­er in the exer­cise of the pow­ers and per­for­mance of the duties here­in pro­vid­ed.  The Liquor Con­trol Com­mis­sion­er may oth­er appoint per­sons to assist in the exer­cise of the pow­ers and per­for­mance of the duties here­in pro­vid­ed, includ­ing but not lim­it­ed to the Coun­ty Clerk, the Sher­iff and the State’s Attorney.
