Ordinance Chapter: Article V - Inmate Medical Service Reimbursement

The Union Coun­ty Board pur­suant to the author­i­ty of the Coun­ty Jail Act, 730 ILCS 125/17 here­by declares thatU­nion­Coun­ty shall reim­burse pri­vate hos­pi­tals, physi­cians or oth­er agen­cies pro­vid­ing med­ical ser­vices to inmates of the Union Coun­ty Jail at the same rate as that paid by the Illi­nois Depart­ment of Pub­lic Aid for med­ical assistance.

The pur­pose of this Arti­cle is to ease the finan­cial bur­den onUnion­Coun­ty for med­ical ser­vices for arrests due to the fact that pub­lic aid rates are nor­mal­ly less than the usu­al rates charges for such services.

This Arti­cle is adopt­ed and enact­ed pur­suant to the author­i­ty grant­ed to the Coun­ty by all rel­e­vant State and Fed­er­al laws, includ­ing but not lim­it­ed to the following:

730 ILCS 125/17 pro­vides that when med­ical or hos­pi­tal ser­vices are required by any per­son held in cus­tody, the coun­ty, pri­vate hos­pi­tal, physi­cian or any pub­lic agency which pro­vides such ser­vices shall be enti­tled to obtain reim­burse­ment from the coun­ty or from the Arrestee’s Med­ical Costs Fund to the extent that mon­eys in the Fund are avail­able for the cost of such services.

Fur­ther, pur­suant to 730 ILCS 125/17 the­Coun­ty­Board is autho­rized to adopt this Ordi­nance pro­vid­ing for reim­burse­ment for the cost of those ser­vices at the Depart­ment of Pub­lic Aid’s rates for med­ical assistance.
