(A) Uphol­stered or oth­er fur­ni­ture designed or man­u­fac­tured pri­mar­i­ly for indoor use shall not be used or allowed to remain:

  • on unen­closed exte­ri­or porch­es or balconies;
  • in an open area on pri­vate prop­er­ty exposed to out­door weath­er conditions.

(B) It shall not be a defense to said pro­hi­bi­tion that such fur­ni­ture is cov­ered by plas­tic cov­er, or oth­er tar­pau­lin, can­vas or sheeting.

(C) This pro­hi­bi­tion shall not apply to the following:

  • wood, met­al, or plas­tic furniture;
  • out­door patio fur­ni­ture with weath­­er-resis­­tant cushions;
  • uphol­stered fur­ni­ture des­ig­nat­ed for pre­paid spe­cial pick­up or deliv­ery by pub­lic or pri­vate hauler, pro­vid­ed that such remain out­doors for a peri­od not to exceed sev­en­­ty-two (72) hours.
